They did not give provide the Cobb Notification letter they are required to send me since they were accepting my late payments. They are Ally financial and have class action law suits against them for this exact issue and also within the state of Minnesota where they paid $780 in settlement due to them not following proper protocol per state laws.
I got behind in payments when I was laid off last year, notified them of my lay off, they wouldnt do any payment arrangement or payment assistance since my loan was so new so when I regained employment I have been paying monthly payment plus additional amount each month to get caught up. They closed my account in February regardless of those payments they had been accepting (without me knowing it until today) and continued taking my payments. Last payment was on 4/17/23 for $900. They repod vehicle on 5.7.23 with no Cobb notice sent to me.
I would have been able to get completely current with my auto loan within the next 30 days if they would notified me of the repossession action and allowed me to make large payments now and then in two weeks when I get paid again. They are telling me since they closed my account they wont even allow a payment arrangement to get current and I either pay loan in full or they will sell my vehicle.

Preferred solution: Them to let me pay back payments owed in full immediately and then them to reinstate my loan and return my vehicle to me

I have request a satisfaction of lien request twice with no luck.
This matter is regards to my Ally financial auto payments.
Recently I've noticed that two payments was deducted from my account. I then contacted Ally to see what the problem was.
They resolved the matter and decided to return one of the payments. I've later received an email saying the payment was return in the form of a check which I didn't receive. I contacted Ally again because I didn't receive the check or any form of payment.
I ask if there any possible they could hold that check for my next month's payment and they told me yes. I later found out that the check wasn't used for my next due date, and so I did not have enough funds in the bank which caused my account to overdraft.

Terrible customer service
Daughter called to get a letter stating the vehicle was paid off on Monday 6/5. She was told it would be faxed in 1-2 business days.
I (co-signer) called on 6/7 and they had no record of her call. They told me it would be 1-2 business days and it would be faxed. Called Friday - still not sent. They said it would be 2-3 hours.
Called Saturday morning 6/10 - they said it would be sent without the hour. Called two hours later and was told - oops, itll be Monday. This level of incompetence is almost unbelievable. It feels like they are refusing to send the letter.
My daughter was rear-ended and her car was totaled. She needs to buy another car but cannot get the insurance money until she gets this letter. This company is ridiculous.
If you can avoid using this company, that would be advisable. Im not sure anyone knows what they are doing.

Did you make atleast 1 year of on time payments> You have to make the first year on time.
That’s not Minnesota law. They still were required to send a Cobb notice if they were accepting my late payments, which they had been.
And I was consistently making monthly payments to make up for those months I missed.
So by Minnesota law, they were required to send a cobb notice prior to repossessing my vehicle and then also required to send a new Cobb notice after each late payment they accepted thereafter. This was not done.
It is the law. Several court rulings have stated so.
